1.Agreement to These Terms
These Terms of Service (the "Terms") form a binding agreement between you and Arbos Folk (an Enkeltmandsvirksomhed registered in Denmark, CVR 46278895, with its address at Byhøjvænget 17, 8380 Trige, Denmark) governing your access to and use of the website arbosfolk.com (the "Site") and any goods, services, downloads, mailing lists, or interactions offered through it.
By accessing or using the Site you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.
These Terms cover the Site itself. Products and brands operated under the Arbos Folk umbrella — for example our Techne products ARA (ara.earth) and HILT (hilt.my) — have their own terms which apply when you use those products.
2.About Arbos Folk
Arbos Folk is a small creative house cultivating six branches:
- Crafts — handmade physical goods including ceramics, wooden utensils, candles, soaps, textiles, and needle-felted figures.
- Imago — limited-run art prints, including AI-assisted compositions that we curate, refine, and print as giclées.
- Sonus — original music compositions and recordings.
- Games — tabletop and digital games.
- Techne — software products for makers and communities, including ARA and HILT.
- Publishing — serialised novels and chronicles.
The Site exists primarily as a window onto these branches — an editorial and discovery surface. Where a branch sells goods or services, those transactions are most often handled by a third-party marketplace (Etsy, Bandcamp, Substack). See Section 7.
We may add, remove, or change branches and products at any time. Nothing on the Site is an offer to enter into a binding contract unless we explicitly say so at the point of sale.
3.Eligibility
You may use the Site if:
- You are at least 16 years old, or have the consent of a parent or legal guardian if you are between 13 and 16; and
- You have the legal capacity to enter into a binding contract in your jurisdiction; and
- You are not barred from receiving services under the laws of Denmark, the European Union, or any other applicable jurisdiction.
Some of our products (certain games and novels) are suitable for mature audiences. Where age guidance is given for a specific product, you must respect it.
4.Acceptable Use
When using the Site you agree not to:
- Use the Site for any unlawful, fraudulent, or deceptive purpose;
- Interfere with or compromise the integrity, security, or performance of the Site, its hosting infrastructure, or other users' use of it;
- Attempt to gain unauthorised access to any account, server, system, or network connected to the Site;
- Upload or transmit viruses, malware, worms, time-bombs, logic-bombs, or any other material designed to disrupt or damage;
- Use any robot, spider, scraper, or other automated means to access the Site or extract data without our prior written permission, except for the limited automated indexing performed by widely-respected search engines and language-model crawlers operating in good faith;
- Harvest or collect personal information from the Site or its users;
- Impersonate Arbos Folk, our team members, or any other person or entity;
- Use the Site in a way that breaches any applicable law or regulation, infringes third-party rights, or is otherwise harmful.
We reserve the right to investigate suspected breaches and to restrict, suspend, or terminate access to the Site at our discretion.
5.Intellectual Property
5.1 Our content
All content on the Site — including text, photographs, graphics, logos, illustrations, audio, video, digital art, downloadable files, software, and the selection and arrangement of all of the above — is owned by Arbos Folk or by our collaborators and licensors, and is protected by Danish, EU, and international copyright, trademark, design, and other intellectual property laws.
"Arbos Folk", "Arbos Techne", "Arbos Crafts", "Arbos Imago", "Arbos Sonus", "Arbos Games", "Arbos Publishing", "ARA", "HILT", and the Arbos device marks are unregistered or registered trademarks of Arbos Folk. You may not use these marks without our prior written permission, except to factually refer to us.
5.2 Your licence to use the Site
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your personal, non-commercial use. All other rights are reserved.
5.3 AI-assisted art (Imago)
Works in the Imago collection are produced through a collaborative process involving human direction, selection, refinement, and finishing alongside generative AI tools. We retain all rights in the refined, curated works and the prints we sell. We do not assert ownership over the underlying training data or generic model outputs.
5.4 User-submitted content
If you send us an email, message, suggestion, or other communication, we may store and refer to it as part of our records. We will not publish or attribute content to you without your consent, unless the content has obviously been provided for publication (for example, an explicit testimonial). You represent that any content you send is yours to send and does not infringe a third party's rights.
7.Purchases & Third-Party Platforms
Most goods and services associated with Arbos Folk are sold through third-party platforms that we do not own or operate. When you make a purchase on one of those platforms:
- The transaction is between you and the platform (and, where the platform acts as a marketplace, the seller of record);
- The platform's terms of service, privacy policy, refund policy, and dispute-resolution mechanisms apply;
- Arbos Folk is not responsible for the platform's performance, security, billing, or compliance, beyond fulfilling our role as a seller where we are one.
Current platforms we use include:
- Etsy — for Crafts and Imago prints;
- Bandcamp — for Sonus music releases;
- Substack — for serialised fiction from Publishing.
We encourage you to read the terms and privacy policies of those platforms before purchasing. If you purchase a physical good and it arrives damaged, defective, or significantly different from what was described, contact us at hello@arbosfolk.com within 14 days of delivery — we will work with you and with the platform to put it right, including where required by EU consumer-protection law.
8.Right of Withdrawal (EU Consumers)
If you are a consumer in the European Union and buy a tangible good directly from Arbos Folk, you have the right under Directive 2011/83/EU to withdraw from the contract within 14 days of the day on which you (or a third party nominated by you, other than the carrier) receives the goods, without giving any reason.
To exercise the right of withdrawal you must inform us of your decision by an unambiguous statement sent by post or email to:
Byhøjvænget 17, 8380 Trige, Denmark
Email: legal@arbosfolk.com
You may, but are not required to, use the model withdrawal form below:
To: Arbos Folk, Byhøjvænget 17, 8380 Trige, Denmark / legal@arbosfolk.com
I/We hereby give notice that I/we withdraw from my/our contract of sale of the following goods: [description of goods, order number].
Ordered on: [date] · Received on: [date]
Name of consumer(s): [name]
Address of consumer(s): [address]
Signature (if sent on paper): [signature]
Date: [date]
To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the 14-day period has expired.
Effects of withdrawal. If you withdraw, we will reimburse all payments received from you, including standard delivery costs (but not extra costs arising from a delivery option you chose other than our cheapest standard delivery), without undue delay and no later than 14 days from the day we receive your withdrawal notice. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earliest. You must send the goods back to us within 14 days of notifying us. You bear the direct cost of returning the goods. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
The right of withdrawal does not apply to certain goods exempted by Article 16 of Directive 2011/83/EU, such as goods made to your specifications or clearly personalised.
9.External Links
The Site contains links to third-party websites and services that are not controlled by Arbos Folk. We are not responsible for, and do not endorse, the content, privacy practices, or operations of any third-party site. Following such a link is at your own risk and is governed by the terms and policies of that third party.
10.Disclaimer of Warranties
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Arbos Folk disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, title, non-infringement, and freedom from defects or errors.
We do not warrant that the Site will be uninterrupted, secure, virus-free, or error-free, that any defects will be corrected, or that the Site will meet your requirements. Any reliance you place on the Site is strictly at your own risk.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including any statutory rights you have as a consumer under Danish or EU law.
11.Limitation of Liability
Subject to Section 10 and to the maximum extent permitted by applicable law, Arbos Folk and its contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site or its content.
Where we are liable to you, our total aggregate liability arising out of or in connection with these Terms — whether in contract, tort (including negligence), or otherwise — will not exceed the greater of (a) the amount you have paid to Arbos Folk in the 12 months preceding the event giving rise to the claim, or (b) DKK 1,000.
Nothing in this clause limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
12.Indemnity
You agree to indemnify and hold Arbos Folk and its contributors harmless from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right. This clause does not apply to claims by consumers exercising statutory rights that cannot be indemnified away under applicable law.
13.Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have breached these Terms, if required by law, or if continuing to provide access would expose us or other users to material harm.
Termination does not affect any rights, remedies, or obligations that have accrued before termination, and the following sections survive: 5 (Intellectual Property), 10 (Disclaimer), 11 (Limitation of Liability), 12 (Indemnity), 15 (Governing Law), 16 (Dispute Resolution), and 18 (Miscellaneous).
14.Force Majeure
Arbos Folk is not liable for any delay or failure to perform under these Terms caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fires, floods, pandemics, epidemics, war, terrorism, riots, civil unrest, government action, embargo, labour disputes, internet outages, failure of telecommunications networks, or failure of a third-party service provider on which the Site depends.
15.Governing Law
These Terms and any dispute arising out of or in connection with them or their subject-matter are governed by and construed in accordance with the laws of Denmark, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer in the European Union, you also benefit from any mandatory provisions of the law of your country of residence that cannot be derogated from by contract.
16.Dispute Resolution
Before starting formal proceedings, we encourage you to contact us at legal@arbosfolk.com so we can try to resolve the matter informally. Most disputes can be solved this way.
If the dispute is not resolved within 30 days, you and we agree that the courts of Denmark have exclusive jurisdiction, and specifically the City Court of Aarhus (Retten i Aarhus) as the court of first instance, unless mandatory consumer-protection rules require otherwise. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform to attempt to resolve the dispute out of court.
17.Changes to These Terms
We may modify these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. For material changes — those that meaningfully affect your rights — we will post notice on the Site at least 30 days before they take effect, and (where we have your email address) try to notify you by email.
Your continued use of the Site after a change takes effect constitutes acceptance of the updated Terms. If you do not agree, your remedy is to stop using the Site.
18.Miscellaneous
18.1 Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices we publish on the Site, constitute the entire agreement between you and Arbos Folk concerning the Site and supersede any prior oral or written agreements between you and Arbos Folk relating to its subject matter.
18.2 Severability
If any provision of these Terms is held unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to render it enforceable, or, if it cannot be so modified, severed; the remaining provisions will remain in full force and effect.
18.3 No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
